PRIVACY POLICY

LLMOCO PRIVACY POLICY

Effective Date: February 26, 2025

1. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy explains how LLMOCO (collectively referred to as "LLMOCO", "we", "our", or "us") collects, uses, and shares information about you ("you", "your", or "user") when you interact with our Services. The "Services" include our website (LLMOCO.com), any mobile or desktop applications we offer, all products and services provided through our website or applications, and our social media pages (such as Instagram, Twitter, and Facebook).

This Policy also outlines the legal rights and responsibilities of both you and LLMOCO regarding "Personal Information"—information that identifies you or could be used to identify you, such as your name, contact details, account information, and data about how you use our website. LLMOCO takes the security of your Personal Information seriously and is committed to upholding your privacy rights.

2. APPLICABILITY OF THIS PRIVACY POLICY

This Privacy Policy is part of our Terms of Use, which govern your access to and use of the Services. For simplicity, we refer to accessing, using, transmitting, or exchanging information, or utilizing features of the Services as "use" throughout this Policy.

What This Policy Covers

This Policy applies to Personal Information we collect from or about you through the methods described in Sections 5 ("Information We Collect") and 7 ("How We Use Your Information") to provide the Services. It applies regardless of how you access the Services (e.g., via web browser, mobile app) and includes targeted content—such as online offers and ads for our products or services—that you may see on third-party websites, platforms, or applications ("Offer Sites") based on your online activity. Offer Sites may have their own privacy policies and terms; we encourage you to review them before using those sites.

What This Policy Does Not Cover

  • Third-party service providers: This Policy does not apply to information collected by third parties that assist us in operating the Services, such as Shopline Inc. (our e-commerce platform host), PayPal Inc. (our payment processor), and social media platforms. Their collection and use of your information are governed by their own privacy policies, and we are not responsible for their compliance.
  • Linked websites: We may link to other websites that we believe may be useful to you, but we have not reviewed their security or privacy practices. Accessing these third-party sites through our links means you are subject to their privacy policies, not ours. LLMOCO is not responsible for the content, privacy, or security of linked websites.

LLMOCO is a subsidiary of Color Image Apparel Inc.

3. ACCEPTANCE OF THIS PRIVACY POLICY

By using LLMOCO’s Services (including visiting our website), you acknowledge that you have read, understood, and agree to this Privacy Policy. If you do not agree to these terms, please do not use our Services. Your continued use of the Services after we post changes to this Privacy Policy constitutes your acceptance of those changes.

4. AGE OF CONSENT

By accessing the Services, you represent that you are at least the age of majority in your state or province of residence. If you are of the age of majority, you may also consent to allow your minor dependents to use the Services. We do not knowingly collect information from minors, and the Services are not intended to solicit information from individuals under the age of majority.

5. INFORMATION WE COLLECT

We collect information in three main ways: information you provide directly, information collected automatically when you use the Services, and information from third-party sources.

5.1 Information You Provide Directly

Providing Personal Information to us is voluntary, but if you choose not to provide certain requested information, we may be unable to provide you with specific products, services, or information. We collect this information when you:

  • Create an online account, make a purchase, or return a product
  • Sign up for our emails, newsletters, or promotional updates
  • Participate in giveaways, sweepstakes, contests, promotions, or surveys
  • Communicate with us via phone, email, or social media (e.g., Facebook, Instagram)
  • Reserve an LLMOCO yoga class, request customer support, or apply for a job
  • Schedule a class, purchase a gift card for someone else, create a wishlist, or ship products to a third party

Types of information you may provide include: your name, shipping/billing address, zip/postal code, phone number, email address, birthdate, payment details (e.g., credit card information), product/communication preferences, demographic information, and any other details you choose to share.

If you provide information about others (e.g., a gift recipient), we will use it only to fulfill your request and will not send marketing communications to those individuals unless they separately opt in.

5.2 Information We Collect Automatically

To enhance your online experience, LLMOCO, our partners, and vendors automatically collect certain information when you use the Services, interact with our emails or ads, or transact with us. This includes:

  • Log file information: Details about your use of our website, such as your browser type, access dates/times, pages viewed, IP address, and the referring link that led you to our site. An IP address is a unique number that identifies your device on the internet. We use this data to analyze trends, track traffic flow, and diagnose technical issues—all in aggregated form that does not identify you personally.
  • Cookies and similar technologies: Our website, ads, and emails use first-party (set by us) and third-party (set by partners) cookies, pixel tags, and other tools to collect information like your browser type, links clicked, and actions taken. Cookies are small data files stored on your device that help us personalize your experience, improve our website, measure marketing success, and enhance security. Most browsers accept cookies by default, but you can adjust settings to refuse cookies or be notified when they are set. Note that disabling cookies may prevent certain features (e.g., shopping cart) from working properly. For more details, see our Cookie Policy.
    • For Google Analytics users: We anonymize your IP address before storing or processing data. To opt out of Google Analytics tracking across all websites, visit https://tools.google.com/dlpage/gaoptout.
  • Transaction information: Details about your purchases or returns, such as product specifics, purchase/return date, and location.
  • Mobile device information: If you access the Services via a mobile device, we may collect your location (if enabled) and unique device identifiers.

5.3 Information From Third-Party Sources

We may receive information about you from third parties, including:

  • Service providers like Shopline, PayPal, and Google
  • Social media platforms where you interact with our brand

We add this information to the data we associate with your account.

5.4 Information We Do Not Intend to Collect

We do not intend to collect or retain sensitive Personal Information, data regarding minority status, or data from third parties that is not expressly authorized by this Policy or a contract. We do not knowingly contact or collect information from minors.

6. TEXT MESSAGE/SMS CONSENT AND OPT-OUT

We may send you text messages (SMS) via an automated dialing system in two limited scenarios:

6.1 Shipping Alerts via DHL

If you provide your mobile phone number, you consent to receive automated shipping alerts from our third-party shipper, DHL Express. Message and data rates may apply (check with your carrier). To opt out, follow the instructions included in DHL’s text messages. For details on how DHL handles your information, review their privacy policy.

6.2 Marketing Text Messages

If you opt in to our marketing text messages, we may send periodic updates about products, promotions, or offers we think you’ll enjoy. Consent is voluntary and not required to make a purchase. To opt out, follow the instructions in our text messages. Message and data rates may apply.

6.3 Additional Terms for Text Messages

We may share your mobile number with service providers assisting us with these activities but will not share it with third parties for their own purposes without your consent. We do not control message delivery by mobile carriers and cannot guarantee service availability, transmission delays, or message success. LLMOCO disclaims liability for issues related to third-party carriers or service providers.

7. SECURITY OF PERSONAL INFORMATION TRANSMISSION

No transmission of information via the internet or email is completely secure. While we use commercially reasonable efforts to protect the Personal Information you submit, we cannot guarantee its security during transmission—any transmission is at your own risk. Once we receive your information, we use industry-standard procedures and security features to prevent unauthorized access.

8. HOW WE USE YOUR INFORMATION

We use your Personal Information to provide, improve, and secure our Services, and to support our business operations. Below are the key purposes:

8.1 Provide, Improve, and Develop the Services

9. HOW WE SHARE YOUR INFORMATION

We share your Personal Information only in the following circumstances, and only under confidentiality agreements where required:

9.1 With Color Image Apparel Inc. Brands

If you provide Personal Information to any Color Image Apparel Inc. brand (LLMOCO, Bella+Canvas, Cody, Ingrid & Isabel), we may share it with other brands under the same parent company.

9.2 By You (Public Disclosures)

Any information you post publicly on our website, social media pages, blogs, or product reviews becomes public and is not covered by this Policy.

9.3 With Third-Party Service Providers

We share your information with vendors who perform services on our behalf, such as hosting our e-commerce platform, processing payments, sending communications, and conducting surveys. These providers are only authorized to use your information to fulfill their services for us. Third parties like Shopline and PayPal have their own privacy policies—we recommend you review them.

9.4 With Partner Companies

We may share your information when collaborating with other companies to offer products, services, or promotions.

9.5 For Social Media Integration

If you log into your LLMOCO account via a social media platform, you authorize us to share information with that platform. The platform’s privacy policy governs how your information is used.

9.6 For Legal Requirements

We may share your information to comply with laws, regulations, subpoenas, court orders, or government requests; to protect our rights, property, or safety; or to investigate and prevent illegal activities.

9.7 In Business Transfers

If Color Image Apparel Inc. is sold, merged, or acquired, your Personal Information may be transferred as part of the business assets.

9.8 With Professional Advisors

We may share your information with legal, regulatory, and audit advisors to support our operations (based on our legitimate business interests).

Third parties receiving your information have no independent right to share it further. We use reasonable measures to ensure they comply with data protection laws.

10. HOW WE STORE YOUR INFORMATION

We store your Personal Information only for as long as necessary to fulfill the purposes for which it was collected (e.g., providing services, complying with laws, protecting our legitimate interests). We may retain anonymized data indefinitely for statistical purposes.

When no longer needed, we securely delete your Personal Information or irreversibly anonymize it. Deleted information may remain in archives for legal or business purposes but will not be used to identify you.

11. HOW WE PROTECT YOUR PERSONAL INFORMATION

We use physical, technical, and operational measures to safeguard your Personal Information against unauthorized access, use, or destruction:

  • Limit access to Personal Information to authorized staff and service providers
  • Use password protection and Secure Sockets Layer (SSL) encryption for online transactions (look for a closed lock or unbroken key in your browser to confirm SSL is active)
  • Store encrypted transaction data on servers not connected to the internet

Note that emails sent to us are not secure. We recommend avoiding sending confidential information via email.

12. LOCATION OF YOUR PERSONAL INFORMATION AND YOUR CONSENT

12.1 International Data Transfer

LLMOCO is based in the United States, where data privacy laws may be less stringent than in the European Union (EU) and other jurisdictions. We store and process your information in the U.S., and our service providers (e.g., Shopline, a Canadian company) may transfer your data outside your country of residence.

By using the Services, you consent to the transfer, processing, and storage of your Personal Information outside your country of origin for the purposes outlined in this Policy. For transfers to non-EEA countries, we use legally recognized safeguards:

  • Transfer to countries with privacy laws equivalent to the EEA

12.2 Consent to Electronic Notice of Security Breaches

You agree this notice satisfies any legal requirement to notify you or others acting on your behalf.

13. ONLINE BEHAVIORAL ADVERTISING OPT-OUT
